Effects sworn uner ¹3,000.
Excerpts as follows
I give and bequearth unto my dear wife Grace Fogwill all my household goods and
furniture plate linen china glass and books of whatever nature ......for and
during her natural life.
..invest a sum of money in their own names (Thomas and John Fogwill) jointly
with my said wife in the public funds or upon real security as will produce an
annuity ... yearly sum of forty five pounds per annum and pay the dividend on
interest thereof as the same shall become due unto my said dear wife Grace Fogwill....after
her decease divide the said principal money between my said sons Thomas and John
equally .....Invest the sum of ¹500 in the public funds or on real security
and pay and apply the dividends or interest thereof unto my daughter Jane the
wife of Henry Goodridge or as she shall direct or appoint during her natural
life free from the debts engagements or control of her present or any future
husband ...after her decease do and shall pay the same interest or dividends
unto the said Henry Goodridge for and during his natural life and ...after decease
pay the said principal sum of ¹500 unto each of the children or grandchildren
of the said Jane Goodridge.........as they respectively attain the age of 21,
... and in the next place do and shall invest the sum of ¹400 in the public
funds or on real..... unto my daughter Elizabeth the wife of Robert Chapple of
Totnes aforesaid labourer during her natural life.......
invest such a sum of money as will produce the clear annual sum of ¹5 and
apply the proceeds thereof unto my sister Agnes the wife of George Wills during
her life and after her decease my said sons Thomas and John ...equally divide
the said principal sum ........... shall divide all residue of the said moneys
among themselves in equal .......

Excerpts as follows
I give and bequearth unto my dear wife Grace Fogwill all my household goods and
furniture plate linen china glass and books of whatever nature ......for and
during her natural life.
..invest a sum of money in their own names (Thomas and John Fogwill) jointly
with my said wife in the public funds or upon real security as will produce an
annuity ... yearly sum of forty five pounds per annum and pay the dividend on
interest thereof as the same shall become due unto my said dear wife Grace Fogwill....after
her decease divide the said principal money between my said sons Thomas and John
equally .....Invest the sum of ¹500 in the public funds or on real security
and pay and apply the dividends or interest thereof unto my daughter Jane the
wife of Henry Goodridge or as she shall direct or appoint during her natural
life free from the debts engagements or control of her present or any future
husband ...after her decease do and shall pay the same interest or dividends
unto the said Henry Goodridge for and during his natural life and ...after decease
pay the said principal sum of ¹500 unto each of the children or grandchildren
of the said Jane Goodridge.........as they respectively attain the age of 21,
... and in the next place do and shall invest the sum of ¹400 in the public
funds or on real..... unto my daughter Elizabeth the wife of Robert Chapple of
Totnes aforesaid labourer during her natural life.......
invest such a sum of money as will produce the clear annual sum of ¹5 and
apply the proceeds thereof unto my sister Agnes the wife of George Wills during
her life and after her decease my said sons Thomas and John ...equally divide
the said principal sum ........... shall divide all residue of the said moneys

This is the last will and testament of me John Fogwill of Totnes ..... merchant......
I give and bequath unto my dear wife Mary Fogwill all my household goods and
furniture, linen, plate, china, glass and implements of household to hold the
same and benefit. I give and divide all my freehold and leasehold ............lands,
tenements and hereditaments and parts and shares of freehold and leasehold ..........lands
tenements and hereditaments whatsoever and wheresoever which I hold beneficially
or which are held by any other person or persons for my benefit and of which
I am ....at law or in equity or over which I have any power of appointments or
in which I have any interest predent or remote with their and every of their
rights membered and appren.........unto my brother Thomas Fogwill of Dartmouth
in the said county merchant William Hannaford the younger of Totnes aforesaid
accountant and Joseph Coombe of Totnes aforesaid Malster. To hold as to my real
estate to and to the use of them the said Thomas Fogwill William Hannaford and
Joseph Coombe their ... and ... forever and as to the leasehold estates to them
their executors administrations and ... for all the terms estates and interests
I shall have therein respectively at my death. And I also give and bequath unto
the said Thomas Fogwill, William Hannaford and Joseph Coombe their executors....al
my funded property money and securities for money goods chattels personal and
testamentary estate whatsoever not hereinbefore or disposed of and I direct them
their heris,..... to hold my freehold and leasehold and personal estate upon
the trusts nere....and for the end intent and purposes hereinafter ....and declared
of and concerning the same ....and I nominate and appoint the said Thomas Fogwill
, William Hannaford and Joseph Coombe to be the exectuors in trust (signed) John
Fogwill
of this my last will and testament and I declare it to be my will and direct
that my said executors in trust or the survivors or....... of them his heirs
executors and administrations shall as soon after my decease as he or they shall
deem fit or convenient sell dispose of and convert into money all my personal
estate whatsoever and collect all money which shall be owing to me on simple
contract or on securities and also so soon after my decease as he or they shall
think fit sell and absolutely dispose of my siad freehold and leasehold or private
contract and either altogether and in one lot or in parcells or p........ of
the same and for the most money and best price ... which can be reasonably had
or gotten for the same...shall pay apply and dispose of the money which shall
.....be produced by or from such sale or sales and also the money to be received
for or on account of the said debts and personal estate and aforesaid upon the
several trusts hereinafter expressed and declared, receipts which shall be given
by mysiad executors in trust or the survivor.....for any money to be reeived
under the trusts of this.........that they my said executors in trust and the
survivors... so and shall stand and be possessed of the money to arise from
such sale or sales and of the monies to be collected and got in aas aforesaid
upon the several trusts herinafter declared concerning the same (that is to say
the trust in the first place to discharge all such debts as I may ower at the
time of my death and my funeral and testamentary expenses and after payments
and satisfaction thereof upon trust to pay and apply the residue unto and equally
amongst and between my said wife and my children John Reed Fogwell, Mary Ann
Hawkins Fogwill, Ellen Russell Fogwill, Caroline Amelia Elizabeth Fogwill, Edward
THomas Fogwill and Louisa Maria Fogwill, and all and every the child and children
of any that shall be hereafter born of my said wife in my life time or in due
time after my death on equal shares and propositions the share of my said wife
to be paid and payable to her as soon as conveniently may be after my death and
the shares of said children to be paid and payable to him , her and them respectively
when and as he she or they shall severally and respectively attain the age of
twenty one years or died undter that age leaving issue living at his her or their
death or respective deaths provided always that incase any or either of my siad
children shall die under the said age of twenty one years and without leaving
issue living at his her or their death there upon trust to pay and make over
the share.. shares of such child or children ... unto the survivior or survivors
